PsyStandard Terms of Use

These Terms of Use govern access to and use of PsyStandard, including the PsyStandard website, practitioner verification process, practitioner directory, application forms, verification evidence submission, public practitioner profiles, harm-governance and complaint channels, and any related online services that link to these Terms.
PsyStandard is operated by Pink Elephant, Unipessoal Lda, NIPC 519056582, with registered address at Edifício Amoreiras Square, Rua Carlos Alberto da Mota Pinto, no. 17, second floor, 1070-313 Lisboa, Portugal. In these Terms, “PsyStandard”, “we”, “us” and “our” refer to Pink Elephant, Unipessoal Lda acting in relation to PsyStandard.
By accessing PsyStandard, submitting an application, creating or maintaining a practitioner profile, using the public directory, submitting a complaint, or otherwise using the service, you agree to these Terms. If you do not agree to these Terms, you must not use PsyStandard.
1. Nature of PsyStandard
PsyStandard is a practitioner verification directory for psychedelic coaches, integration specialists, harm-reduction practitioners, retreat facilitators and clinicians across Europe.
PsyStandard is not a healthcare provider, clinic, therapy provider, retreat operator, emergency service, regulator, professional licensing body, or medical authority. PsyStandard does not provide medical advice, psychological advice, legal advice, treatment, diagnosis, crisis support, emergency intervention, or professional supervision to consumers or practitioners.
A PsyStandard listing or badge indicates that PsyStandard has assessed the relevant practitioner according to PsyStandard’s verification criteria and internal assessment process. It does not guarantee that a practitioner is suitable for any particular consumer, client, treatment, retreat, integration process, jurisdiction or legal context. It also does not guarantee a practitioner’s future conduct, availability, insurance coverage, legal compliance, professional outcome or safety.
2. Who may use PsyStandard
PsyStandard may be used by prospective practitioners who register interest, practitioners applying for verification, verified practitioners with active directory badges, directory users seeking information about practitioners, complainants submitting conduct or adverse-event concerns, assessors, supervisors, referees and other persons involved in PsyStandard’s verification or governance processes.
Practitioners who apply for verification represent that they are acting in a professional capacity and that the information they provide is accurate, complete and not misleading.
Directory users are responsible for exercising their own judgment before contacting or engaging any practitioner. PsyStandard does not become a party to any relationship, contract, consultation, retreat, therapeutic engagement, integration session or other arrangement between a directory user and a practitioner.
3. Relationship between PsyStandard and Pink Elephant Education
PsyStandard operates as a functionally separate unit from Pink Elephant’s Education vertical. PsyStandard verification data is maintained in separate data environments and is subject to access controls designed to prevent the Education team from accessing practitioner verification records, application materials or assessment scores, except where expressly authorised and lawful.
Nothing in these Terms gives a practitioner any right to access, influence or receive preferential treatment in any Pink Elephant Education activity, and participation in any Education activity does not automatically entitle a practitioner to PsyStandard verification or listing.
4. Expression of interest and waitlist
A prospective practitioner may submit an email address to register interest in a future PsyStandard directory listing or application process.
By submitting an expression of interest, you confirm that you wish to receive follow-up communications about the PsyStandard directory or application process. You may withdraw this consent at any time by using the unsubscribe method provided or by contacting [email protected].
Expression-of-interest registration does not guarantee access to the application process, eligibility for verification, future listing, badge approval, or any commercial relationship with PsyStandard.
5. Practitioner verification applications
Practitioners may apply for PsyStandard verification through the application process made available by PsyStandard.
The application process may require identity, contact, credential, professional-background, training, insurance, licensing, professional-specialisation, conduct-history, disciplinary-disclosure, reference and application-response information.
You must provide accurate, complete and current information. You must not submit false credentials, misleading professional titles, fabricated references, inaccurate insurance or licensing information, altered certificates, or information that falsely suggests approval, licensing, training or experience that you do not hold.
You must not include identifiable client information, real client case histories, unnecessary health data, unnecessary special-category data, or criminal-offence data in your application unless PsyStandard expressly requests that information and provides a lawful basis and appropriate instructions.
PsyStandard may reject, pause, request clarification on, or decline an application if the information provided is incomplete, inconsistent, inaccurate, unverifiable, misleading, outside the scope of PsyStandard’s criteria, or otherwise insufficient to support verification.
6. Professional references and verification checks
Where the verification process requires professional references, you are responsible for providing accurate referee, supervisor or colleague details and for ensuring that the persons you name are appropriate professional references.
By providing reference details, you understand that PsyStandard may contact those referees, supervisors or colleagues for verification purposes. PsyStandard may process reference responses and reference-check outcomes as part of the application and verification process.
PsyStandard may take reference feedback into account when assessing eligibility. PsyStandard is not required to disclose confidential reference content to the applicant where disclosure would be unlawful, unfair to the referee or inconsistent with applicable rights and obligations, although PsyStandard will comply with applicable data protection rights where required.
7. L0, L1 and L2 verification tiers
PsyStandard may operate different verification tiers, including L0, L1 and L2 processes. The criteria, evidence required and assessment process may differ depending on the tier.
Verification decisions are made according to PsyStandard’s criteria and assessment process. A successful application at one tier does not guarantee eligibility at another tier. PsyStandard may modify its criteria, tier structure or assessment process from time to time, provided that changes are not applied unlawfully or unfairly.
8. Mock sessions and L2 recordings
Where L2 verification requires a mock session or assessment recording, the recording is used as verification evidence and may be assessed by authorised PsyStandard assessors and supervisors.
Mock session recordings must not include real identifiable clients, real client case histories, or unnecessary health or special-category data. The practitioner is responsible for ensuring that any mock-session participant understands the nature of the mock session and has given any required permission for recording and use within the assessment process.
PsyStandard does not use L2 recordings for facial recognition, biometric identification or automated inference. Assessor scoring is manual.
PsyStandard may reject or disregard mock-session evidence that includes real client-identifying information, unnecessary sensitive data, unlawful content, manipulated evidence or content that cannot fairly be used for assessment.
9. Active verification records and badge validity
If a practitioner is verified, PsyStandard may maintain an active verification record, including practitioner ID, badge tier, badge issuance and expiry dates, assessment summary, competency-domain scores, supervisor assessment notes, reference-check outcomes, application history, L2 mock-session recordings and assessment evidence where applicable.
Verification badges remain valid only for the period and conditions stated by PsyStandard. A badge may lapse, expire, be suspended, be withdrawn, or require renewal according to PsyStandard’s criteria and governance process.
A practitioner must not present an expired, suspended, withdrawn or rejected verification as active. A practitioner must not alter a badge, misrepresent the badge tier, or imply broader endorsement than PsyStandard has granted.
10. Public directory profiles
A verified practitioner may have a public profile in the PsyStandard directory while holding an active published directory profile.
The public profile may include full name, professional title, city/country-level location of practice, training background summary, languages spoken, services offered, fees and insurance information where provided, self-authored practitioner bio, contact method or preferences, verification badge tier and verification status.
The practitioner is responsible for ensuring that public profile information is accurate, current and not misleading. The practitioner must not include identifiable client information, client case histories, unlawful claims, unsupported medical claims, misleading therapeutic claims, or unnecessary special-category data in the public profile.
Core public profile information, badge tier and verification status may be necessary for the directory listing. Optional public profile fields are provided at the practitioner’s choice and may be removed or changed according to the available profile-management process.
11. Use of the public directory
The public directory is provided to help users discover verified practitioners and review professional profile information.
Directory users must independently assess whether a practitioner is suitable for their needs. PsyStandard does not recommend a specific practitioner, does not provide medical or therapeutic advice, and does not guarantee any practitioner’s suitability, availability, safety, legality, insurance coverage, scope of practice or outcomes.
A directory user’s contact or engagement with a practitioner is a separate relationship between the user and the practitioner. PsyStandard is not responsible for services provided by practitioners, communications between users and practitioners, pricing, scheduling, clinical or non-clinical advice, professional conduct outside PsyStandard, or any retreat, therapy, integration or coaching arrangement.
12. Practitioner obligations
Practitioners must comply with applicable laws, professional rules, licensing requirements, insurance obligations, ethical duties and scope-of-practice limitations that apply to their work.
Practitioners must not use PsyStandard to promote unlawful services, misrepresent qualifications, claim licences they do not hold, imply medical authority where they are not licensed, or make unsupported claims about treatment, diagnosis, cure, safety or outcomes.
Practitioners must keep their profile and verification information current. If a material fact changes, including licensing, insurance, training status, disciplinary status, practice location, scope of services or eligibility for verification, the practitioner must promptly update PsyStandard or use the available update process.
13. No illegal or unsafe activity
PsyStandard must not be used to facilitate illegal conduct, unlawful controlled-substance activity, unauthorised medical practice, unsafe retreat operations, misleading clinical claims or conduct that violates applicable law.
Practitioners and directory users are solely responsible for understanding and complying with the laws and professional rules that apply to them in their jurisdiction.
14. Harm governance and complaint investigations
PsyStandard may receive, assess and manage complaints or adverse-event reports involving listed practitioners.
Complaints may be submitted by consumers, practitioners or other persons. A complaint may include contact details, incident description, supporting documentation, practitioner name and badge ID, dates and location of the alleged incident, communications, investigation status, outcome and decision documentation, and information about other identifiable persons where included by the complainant.
Complainants should provide truthful and relevant information. They should avoid including unnecessary client-identifying information, unnecessary health information or unnecessary special-category data.
PsyStandard may share relevant complaint information with the complainant and the subject practitioner only to the extent necessary for investigation, fairness, right of response and resolution. PsyStandard does not share individual case data externally as part of ordinary complaint governance.
PsyStandard may take action following a complaint, including requesting further information, closing the matter, issuing a warning, changing verification status, suspending a badge, removing or unpublishing a profile, retaining a legal hold, or taking other proportionate action. PsyStandard is not required to adopt the complainant’s requested outcome.
15. Anonymised aggregate research and statistical outputs
PsyStandard may internally prepare anonymised aggregate research or statistical outputs from verified-practitioner records to support standards and training programme development.
External research partners receive anonymised aggregate outputs only. They do not receive personal data, individual-level records, practitioner IDs, recordings, notes, contact details or access to PsyStandard systems.
PsyStandard may retain anonymised aggregate outputs indefinitely where no practitioner can be identified, linked or singled out.
16. Website analytics
PsyStandard website analytics are anonymised at the point of collection. PsyStandard does not use cross-session tracking of individual website users, advertising or third-party tracking scripts, or session replay.
If PsyStandard changes its analytics configuration so that personal or pseudonymous data is processed before anonymisation, PsyStandard will update its privacy documentation and obtain consent where required.
17. Account, access and security
Where PsyStandard provides account or portal access, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must not share access credentials, allow unauthorized use of your account, attempt to access another person’s account, bypass security controls, interfere with PsyStandard systems, or upload malicious code.
PsyStandard may suspend or restrict access where it reasonably believes this is necessary for security, investigation, compliance, service integrity or protection of users.
18. User-submitted content and evidence
You retain responsibility for the content, information, evidence, documents, recordings, profile text, complaint materials and other submissions you provide to PsyStandard.
You grant PsyStandard a limited licence to use, host, store, copy, review, assess, display, publish where applicable, transmit where necessary, and otherwise process your submissions only as necessary to operate PsyStandard, assess applications, maintain verification records, publish authorised public profiles, investigate complaints, secure the service, comply with legal obligations and exercise or defend legal claims.
You must ensure that your submissions do not infringe third-party rights, breach confidentiality obligations, include unlawful material, include unnecessary sensitive data, include real client-identifying information where prohibited, or contain misleading or false statements.
19. Intellectual property
PsyStandard, including its name, branding, website, directory structure, verification framework, badge designs, assessment materials, text, interface, software, documentation and related materials, is owned by Pink Elephant, Unipessoal Lda or its licensors.
Subject to these Terms, PsyStandard grants you a limited, revocable, non-exclusive, non-transferable right to access and use PsyStandard for the purposes permitted by these Terms.
You may not copy, modify, scrape, extract, reproduce, sell, sublicense, reverse engineer, misuse or create derivative works from PsyStandard except where expressly permitted by law or by written permission from PsyStandard.
20. Use of badges and references to PsyStandard
A verified practitioner may refer to their PsyStandard verification only while the relevant badge is active and only in a truthful, non-misleading manner.
A practitioner must not use a PsyStandard badge or reference in a way that suggests licensing, regulatory approval, medical endorsement, guaranteed safety, guaranteed outcomes, or approval beyond the specific verification tier granted.
PsyStandard may require correction or removal of any inaccurate, expired, misleading or unauthorised use of its name, badge, logo or verification status.
21. Third-party services
PsyStandard uses third-party services and processors to operate the service, including tools for forms, hosting, email communications, storage, video meeting or drive functions, CDN/security services and verification evidence storage.
Your use of third-party services may also be subject to their own terms where you interact with those services directly. PsyStandard is responsible for its own processing of personal data as described in the Privacy Notice, but it does not control all third-party platform terms.
22. Privacy
PsyStandard processes personal data as described in the PsyStandard Privacy Notice.
By using PsyStandard, you acknowledge that you have read the Privacy Notice. Where PsyStandard relies on consent, such as for expression-of-interest communications or optional public profile fields, you may withdraw consent as described in the Privacy Notice.
The Privacy Notice explains the controller identity, data categories, purposes, legal bases, recipients, retention periods, rights and complaint channels.
23. Fees and paid services
If PsyStandard charges application, verification, renewal, listing or other fees, the applicable price, payment timing, refund terms and service-specific conditions will be shown before you commit to payment.
If no fee is displayed or agreed for a specific service, these Terms do not create an obligation to pay a fee.
Where mandatory consumer law applies to a specific paid service, statutory consumer rights will apply and cannot be excluded by these Terms. Practitioner applicants applying in a professional capacity may not have the same consumer rights as a consumer acting for personal purposes.
24. Cancellation, withdrawal and unpublishing
A prospective practitioner may withdraw from the expression-of-interest list by withdrawing consent or using the unsubscribe method provided.
A practitioner may request unpublishing of a public profile according to the available process. Public profiles are unpublished within the period stated in the Privacy Notice where the conditions for unpublishing are met.
Withdrawal from an application process, unpublishing of a profile or withdrawal of consent for optional fields does not necessarily require PsyStandard to delete all records immediately where retention is necessary for verification history, complaint handling, legal claims, audit, security, dispute resolution or other lawful reasons.
25. Availability and changes to PsyStandard
PsyStandard may modify, suspend, discontinue or update the website, application process, verification criteria, badge tiers, directory features, profile fields, complaint process, technical systems or other service elements from time to time.
PsyStandard will act reasonably when applying changes to active practitioners, but no practitioner is guaranteed a permanent badge, permanent listing, permanent profile format, fixed search/display format, fixed verification process, or indefinite availability of any feature.
PsyStandard does not guarantee uninterrupted, error-free or continuously available service.
26. Suspension, removal and termination
PsyStandard may suspend, reject, remove, unpublish or terminate access to the service, an application, a badge or a profile where PsyStandard reasonably determines that this is necessary due to inaccurate information, unverifiable credentials, expired or invalid eligibility, breach of these Terms, complaint outcome, security risk, legal risk, misuse of the directory, misleading public claims, unauthorised use of badges, failure to cooperate with verification or harm-governance processes, or other material concerns.
Where appropriate, PsyStandard may allow the practitioner to respond before a final decision is made. In urgent cases, PsyStandard may take interim action before completing a review.
27. Disclaimers
PsyStandard is provided for practitioner verification and directory purposes.
PsyStandard does not guarantee that any practitioner is suitable for a particular consumer, that any practitioner will provide services lawfully or safely, that any engagement will produce a specific outcome, or that any profile information remains accurate after publication if the practitioner fails to update it.
Verification is based on information available to PsyStandard at the time of assessment and on PsyStandard’s criteria. It is not a governmental licence, professional regulator approval, clinical approval, medical endorsement or guarantee of future conduct.
To the maximum extent permitted by law, PsyStandard is provided on an “as is” and “as available” basis.
28. Limitation of liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
To the maximum extent permitted by applicable law, PsyStandard is not liable for indirect, incidental, special, consequential, punitive or exemplary damages, loss of profit, loss of opportunity, loss of goodwill, reputational loss, loss of data, business interruption or similar losses arising from or relating to use of PsyStandard.
To the maximum extent permitted by applicable law, PsyStandard’s total liability for claims arising from or relating to the service is limited to the amount paid by the relevant user to PsyStandard for the service giving rise to the claim during the twelve months before the event giving rise to liability. If no amount was paid, liability is limited to the maximum extent permitted by applicable law.
This section does not limit mandatory consumer rights, liability for intentional misconduct, or any liability that cannot lawfully be limited.
29. Indemnity
Where you use PsyStandard in a professional or business capacity, you agree to indemnify Pink Elephant, Unipessoal Lda against losses, claims, costs, damages and expenses arising from your breach of these Terms, false or misleading submissions, unlawful use of PsyStandard, infringement of third-party rights, unauthorised disclosure of client or third-party information, misuse of a PsyStandard badge, or services you provide outside PsyStandard.
This indemnity does not apply to the extent prohibited by mandatory law.
30. Governing law
These Terms are governed by the laws of Portugal, without prejudice to any mandatory rights that may apply to consumers under the law of their country of habitual residence.
31. Disputes
If a dispute arises, you should first contact PsyStandard at [email protected].
If the dispute cannot be resolved informally, the competent Portuguese courts will have jurisdiction, unless mandatory law gives you the right to bring a claim in another forum.
32. Changes to these Terms
PsyStandard may update these Terms from time to time.
If changes are material, PsyStandard will provide notice in an appropriate manner. Continued use of PsyStandard after the effective date of updated Terms means that you accept the updated Terms, unless applicable law requires a different form of acceptance.
If you do not agree to updated Terms, you must stop using PsyStandard and may request unpublishing or account closure where applicable, subject to retention obligations and lawful exceptions.
